Terms of Service

By accessing or using Pomoflow ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Pomoflow.

You must be at least 13 years old to use the Service. If you are located in the European Economic Area (EEA), you must be at least 16 years old. By using the Service, you represent and warrant that you meet the applicable age requirement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Pomoflow is a web-based productivity application that provides guided timer sessions using a four-phase system (Prep, Focus, Flow, Recovery). The Service is available in a free tier and a paid Premium tier with additional features including analytics, session history, and activity tracking.

You may use the timer without an account. To save settings, track sessions, and access premium features, you must create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your password
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

Accounts must be created by a human individual. Automated or bot-created accounts are not permitted. We reserve the right to suspend or terminate accounts that have been inactive for an extended period, with prior notice sent to your registered email address.

The Premium plan is available as a one-time purchase processed through Stripe. By purchasing Premium, you agree to:

• Pay the listed price at the time of purchase
• Stripe's terms of service for payment processing

Premium access is granted immediately upon successful payment. You can view your payment history and receipt through the Manage Billing option in Account Settings. We reserve the right to change the price of the Premium plan at any time, but any price changes will not affect purchases already completed.

Since Premium is a one-time purchase for digital content, refunds are handled on a case-by-case basis. If you experience issues, contact us at hello@pomoflowapp.com and we will work with you to resolve the situation.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service, other accounts, or systems
• Interfere with or disrupt the Service, its servers, or connected networks
• Scrape, crawl, or use automated means to access the Service beyond normal use
• Create multiple accounts to circumvent free-tier limitations or abuse the Service
• Transmit viruses, malware, or any other malicious code
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service

Violation of these terms may result in immediate suspension or termination of your account.

Pomoflow and its original content, features, functionality, design, and branding are owned by Pomoflow and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from the Service or any of its content without our explicit written permission.

Session goals and reflections you enter are your content ("User Content"). We do not claim ownership of your User Content. By using the Service, you grant us a limited license to store and process your User Content solely to provide the Service to you. We will delete your User Content when you delete your account. We do not use your User Content for advertising, marketing, or training purposes.

The Service integrates with third-party services to operate. By using the Service, you acknowledge that your use may be subject to the terms and privacy policies of these providers:

• Stripe — payment processing (Stripe Terms)
• Google — OAuth authentication (Google Terms)
• Vercel — hosting and anonymous analytics
• Resend — transactional email delivery
• Supabase — database hosting

We are not responsible for the practices or content of any third-party services.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POMOFLOW AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PREMIUM PLAN IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIVE US DOLLARS ($5.00), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Pomoflow and its officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We aim to keep the Service available at all times but do not guarantee uninterrupted or error-free access. We may perform scheduled maintenance, deploy updates, or experience unforeseen outages that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime when possible.

You may delete your account at any time through Account Settings. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users. Upon termination, your data will be permanently and irreversibly deleted from our systems, including all session data, settings, and subscription records.

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in the State of Washington.

Before filing a formal legal claim, you agree to first contact us at hello@pomoflowapp.com and attempt to resolve the dispute informally for at least thirty (30) days. If the dispute cannot be resolved informally, you and Pomoflow agree to resolve any claims through binding arbitration on an individual basis, rather than in court, except that either party may bring claims in small claims court if eligible.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Pomoflow.

We may update these Terms from time to time to reflect changes to the Service, legal requirements, or business practices. For material changes, we will provide at least thirty (30) days' notice via email to the address associated with your account or through a prominent notice within the Service. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Pomoflow regarding your use of the Service and supersede any prior agreements, communications, or understandings, whether written or oral.
